Terms of service

Agreement

These Terms of Service (“Terms”) govern your access to and use of Pastoral Relationship Manager (“PRM,” the “Service”) offered by PRM. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use PRM.

Description of the service

PRM is a software-as-a-service (SaaS) platform for pastoral relationship management. It is designed to help churches and ministry teams organize people data, plan follow-up, log touchpoints, and send communications— including SMS—in support of pastoral care. Features may change over time.

Acceptable use

PRM is intended for church and ministry use in line with applicable law and the rights of individuals whose data you process. You agree not to use the Service for unlawful, harassing, discriminatory, or deceptive purposes; not to send spam or unauthorized marketing; and not to attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or other users’ data.

SMS messaging

SMS capabilities are provided to support legitimate ministry and pastoral communications. Message frequency varies based on your organization’s use and recipient interactions. Message and data rates may apply according to your mobile carrier plan.

Recipients may opt out of SMS by replying STOP. For help with SMS, they may reply HELP or contact the sending organization. You are responsible for obtaining appropriate consent where required before sending messages.

Your responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials and notifying us of unauthorized use.
• Ensuring that your use of PRM, including integrations (such as Planning Center) and messaging, complies with law, your policies, and any agreements with your constituents.
• The accuracy of data you or your organization imports or enters into the Service.

Subscription and billing

Paid plans are billed on a subscription basis. Unless otherwise stated for your organization, pricing is $49 per seat per month (subject to change upon notice for new terms or renewal periods). Fees are exclusive of taxes unless stated otherwise. Failure to pay may result in suspension or termination of access.

Termination

You may stop using PRM at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or for extended non-payment. Provisions that by their nature should survive (including disclaimers and limitations) will survive termination.

Disclaimer and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRM AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS ($100), EXCEPT WHERE PROHIBITED BY LAW.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles, except where preempted by applicable federal law. Courts located in California shall have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to mandatory provisions of law in your jurisdiction where applicable.

Changes

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.
